TOSHIBA TEC SINGAPORE Kiosk Printer software End User License Agreement
THIS END USER LICENSE AGREEMENT (“EULA”) IS A LEGAL AGREEMENT BETWEEN YOU (“YOU”) AND TOSHIBA TEC SINGAPORE GOVERNING YOUR USE OF THE SOFTWARE. PLEASE READ THE TERMS AND CONDITIONS OF THIS EULA CAREFULLY BEFORE USING THE SOFTWARE. BY DOWNLOADING, INSTALLING OR OTHERWISE USING THIS SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE ON BEHALF OF YOURSELF AND YOUR COMPANY OR ORGANIZATION.
IF YOU DO NOT ACCEPT THE TERMS AND CONDITIONS OF THIS EULA, DO NOT USE, COPY, DOWNLOAD OR INSTALL THE SOFTWARE, AND YOU MUST UNINSTALL THE SOFTWARE FROM ALL DEVICES THAT YOU OWN OR CONTROL.
1. You may use this Kiosk Printer software (including printer driver, tools, data, parameters, collectively “Software”) on a single TOSHIBA TEC SINGAPORE Kiosk Printer purchased from (i) dealer or distributor of TOSHIBA TEC SINGAPORE, or (ii) dealer, distributor or affiliated company of TOSHIBA TEC.
2. You shall not grant a sublicense, distribute, transfer, lend or otherwise dispose of this Software, in whole or in part, for the use of any third party without prior written consent to TOSHIBA TEC SINGAPORE.
3. You shall not modify, reverse engineering, reverse compile or reverse disassemble this Software, in whole or in part, for any purpose.
4. You shall not copy or make a duplicate (including backup copy) of this Software, in whole or in part.
5. All title and copyrights in and to this Software are owned by TOSHIBA TEC SINGAPORE.
6. TOSHIBA TEC SINGAPORE makes no representation or warranty, whether expressed or implied, including but not limited to correction of any error or failure, maintenance or support relating to this Software.
7. IN NO EVENT SHALL TOSHIBA TEC SINGAPORE BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGE ARISING OUT OF THE USE OR INABILITY TO USE THIS SOFTWARE, EVEN IF TOSHIBA TEC SINGAPORE HAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, NOR FOR ANY CLAIMS BY A THIRD PARTY.
8. TOSHIBA TEC SINGAPORE may terminate this Agreement if you fail to comply with any of this terms and conditions. Upon the termination of this Agreement, you shall uninstall the Software and/or return it to TOSHIBA TEC SINGAPORE.
9. This Agreement shall become effective upon the installation or use of this Software by You. By installing or using this Software you hereby indicate your acceptance of these terms and conditions.
10. The laws of Singapore, excluding its conflict of law provisions, govern this license and your use of the Software.
